2. Application of Terms
These Terms govern the sale of products on www.mumanddad.dj. By placing an order, you agree to these Terms and Conditions. They apply to all consumers in Belgium and the European Union unless otherwise stated. Any deviation from these Terms requires explicit written agreement from GEMAP SRL.
3. Products and Availability
We strive to provide accurate product descriptions, images, and specifications. All product information is for guidance purposes. While we attempt to maintain accurate stock levels, product availability is subject to change without prior notice. We reserve the right to cancel any order if products are unavailable.
4. Prices
All prices are indicated in EUR and include Belgian VAT unless otherwise specified. Shipping and handling fees are additional and displayed during checkout. We reserve the right to correct errors or omissions in pricing and descriptions.
5. Orders
Orders are confirmed once payment is received. Confirmation emails serve as evidence of the contract. We may refuse or cancel orders in cases of suspected fraud, pricing errors, or stock shortages. Customers are responsible for providing accurate contact and delivery information.
6. Payment Methods
We accept the following payment methods: Paypal, Visa and Mastercard. All payments are processed securely through our payment partners. Payment must be completed before order dispatch.
7. Delivery
Delivery is available to: worldwide. Estimated delivery times are provided during checkout. Risk of loss or damage passes to the customer upon delivery. Customers should inspect the goods upon receipt and report any issues within 48 hours.
8. Right of Withdrawal
Under Belgian and EU law, consumers have 14 days from receipt to withdraw from the contract without providing reasons. To exercise this right, notify us at [email protected] and follow the return procedure outlined in the Returns Policy. Certain items, including customized, perishable, or hygiene-sensitive products, are exempt from the withdrawal right.
9. Warranty
All products sold are covered by the Belgian legal guarantee of conformity for two years from delivery. Any defect or non-conformity must be reported promptly. The warranty does not cover damage caused by misuse, normal wear, or external factors.
10. Liability
GEMAP SRL is not liable for indirect, incidental, or consequential damages arising from product use. Our maximum liability is limited to the value of the purchased product. This does not affect mandatory statutory rights.
11. Force Majeure
We are not liable for delays or non-performance due to circumstances beyond our control, including natural disasters, strikes, transport issues, or government actions.
12. Intellectual Property
All content on the website, including images, text, and logos, remains the intellectual property of GEMAP SRL. Reproduction or unauthorized use of website content is prohibited.
13. Governing Law and Jurisdiction
These Terms are governed by Belgian law. Disputes fall under the jurisdiction of the courts of Brussels, Belgium.
